DSTV Shutdown? Not Possible—Law and Constitution Stand Strong for Business Rights in Ghana

Hon. Samuel Nartey George cannot shut down DSTV. The law and authority to do so do not rest with him. Even local free-to-air television stations are beyond his power to shut down, let alone DSTV—a well-established company that has fully complied with all regulatory requirements and continuously pays its taxes to the state. Ghanaians, it is important to lower your expectations and understand the legal realities at play.

In Ghana, businesses enjoy the same constitutional protections as individuals. These include the rights to due process, fair treatment under the law, and the freedom to conduct lawful business activities. Any attempt to take action against DSTV that disregards these fundamental rights would be legally indefensible and subject to challenge in court.

Moreover, DSTV has binding contractual agreements with content providers, satellite operators, and countless business partners. An unlawful shutdown would not only jeopardize these relationships but also expose the government or any other party to costly lawsuits for breach of contract and damages. DSTV has the full right to defend its business interests against any unwarranted interference.

DSTV operates under a license issued by the National Communications Authority (NCA), which clearly lays out the terms and conditions for its operation. For DSTV to be legitimately shut down, the government or the NCA must provide compelling and verifiable evidence of a serious breach of these licensing terms—something that has not been demonstrated.
